The focus of this blog is primarily on the decisions of the North Carolina Business Court. I'll also try to report on business-related decisions of the North Carolina Court of Appeals and the North Carolina Supreme Court.
The Business Court, modeled after the Delaware Court of Chancery, was one of the first Courts in the country to focus exclusively on complicated business disputes. A national expert who has written extensively on the subject of business courts has referred to North Carolina's Court as "a real gem" and said that its use of technology represents a "gold standard" among courts. Those statements were made in an article which includes an interview of Judge Tennille.
This blog has information on the Judges of the Court, the jurisdiction of the Court, and the history of the Court.
The Court delivers a steady stream of opinions on disputes involving mergers, shareholder rights, fiduciary duties, trade secret issues, non-competition agreements, and other issues of all shape and size that bear on business in North Carolina. The Business Court often writes on a clean slate, before the North Carolina appellate courts reach the issue. Its opinions are thorough, well-researched, and well-written.
I haven't ignored the twelve years of Business Court opinions before the launch of this blog. The Case Database on this blog contains summaries, searchable by key word, of all of the published decisions of the Court from the first opinion to date. The Database also contains a number of the Court's unpublished decisions.
